Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules you must follow when using any service provided by SagaHosting ("we", "us", "our"), operated by ANSHU, a sole proprietorship registered in India. By purchasing or using any service (Minecraft hosting, Discord bot hosting, web hosting, VPS, or any other service we offer), you agree to this policy in full.
This policy is part of, and incorporated into, our Terms of Service. If you do not agree with this policy, do not use our services.
1. Scope
This policy applies to every service we operate, including but not limited to Minecraft game servers, Discord bot hosting, web hosting, VPS servers, control panel access, SFTP access, and any related feature.
2. Prohibited Activities
You must not use our services — or allow any third party to use them through your account — to engage in any of the following:
2.1 Illegal & Harmful Content
- Any activity that violates Indian law or the laws of your jurisdiction
- Child sexual abuse material (CSAM) or any content that sexualises minors
- Content that promotes terrorism, violence, or hatred against any group
- Phishing, fraud, scams, or deceptive schemes
- Distribution of malware, ransomware, trojans, or spyware
- Selling or facilitating the sale of illegal goods or services
2.2 Network & Infrastructure Abuse
- DDoS or DoS attacks against any target, including our own infrastructure
- Port scanning, vulnerability scanning, or penetration testing of any system you do not own or have explicit written permission to test
- Sending spam, unsolicited bulk email, or operating mail relays
- Operating botnets, command-and-control servers, or proxy networks for abuse
- Attempting to escape the container, access the host system, or interact with other customers' servers
- Scanning, probing, or attacking our network or any third party's network
- Using our services as a launchpad for any form of network attack
2.3 Cryptocurrency Mining
Cryptocurrency mining of any kind is strictly forbidden on all services. This includes CPU mining, GPU mining, and mining pools. Our plans are priced for the workloads described on our pricing pages — not for mining.
2.4 Resource Abuse & Fair Use
- Sustained use of 100% CPU for extended periods on shared plans (other than legitimate server operation)
- Abusing disk space beyond your plan's limit
- Running background processes not related to your hosted service
- Circumventing resource limits, quotas, or throttling
- Using your VPS as a public proxy, VPN, or Tor exit node
- Streaming, encoding, or bulk-processing workloads on non-VPS plans
2.5 Intellectual Property
- Uploading or distributing content you do not have the right to share
- Hosting pirated software, games, media, or "cracked" content
- Violating copyright, trademark, or patent rights of any party
- Removing or altering copyright notices
2.6 Commercial Abuse
- Reselling our services without prior written agreement
- Opening multiple accounts to evade suspension, bans, or abuse fees
- Charging third parties for access to your account or services
- Using free, trial, or discounted plans for commercial resale
2.7 Discord-Specific Rules
- Raiding, spamming, or abusing Discord servers
- Self-bots, user-bots, or automating a user account against Discord's Terms of Service
- Scraping Discord data without permission
- Operating bots that violate Discord's Developer Terms or Community Guidelines
2.8 Minecraft-Specific Rules
- Running game-cracking, piracy, or unauthorized server software
- Hosting servers that advertise or promote piracy ("cracked" servers marketed to bypass Mojang)
- Using exploits to crash or lag other servers
- Server-side backdoors or hidden malware in uploaded plugins
3. Reporting Abuse
If you believe one of our customers is violating this policy — for example, attacking your server, hosting phishing content, or sending spam — report it to [email protected] or [email protected].
Include the offending IP address, hostname, timestamps, and any evidence. We investigate every report and respond within 72 hours.
4. Investigation & Enforcement
When we suspect a violation, we may:
- Inspect logs, process lists, network activity, and file metadata associated with your service
- Suspend the affected service immediately if the violation is severe (e.g. DDoS, CSAM, active abuse)
- Request an explanation from you before taking permanent action, unless the violation is urgent
4.1 Escalation Steps
- Step 1: Warning — for minor, first-time violations
- Step 2: Suspension — service offline, data retained, abuse fee applies
- Step 3: Termination — account deleted, data destroyed, no refund
- Step 4: Legal referral — for criminal activity
Severe violations (DDoS attacks, CSAM, cryptocurrency mining, phishing campaigns) may skip directly to Step 3.
5. Abuse Processing Fee
If your account is confirmed to have engaged in prohibited activity under Section 2, you agree to pay an Abuse Processing Fee of ₹5,000 (Five Thousand Rupees) per confirmed incident.
This fee represents a genuine pre-estimate of the reasonable cost we incur to investigate, contain, and remediate abuse — including engineer time, log analysis, container cleanup, IP reputation restoration, and communication with upstream providers.
Additionally, you are liable for:
- Any direct damages we suffer — including fines, penalties, or termination notices from our data centre, bandwidth provider, or upstream transit partners
- Cost of IP reputation cleanup (delisting from spam/abuse blocklists)
- Cost of forced emergency migration if our hosting provider requires it
- Reasonable legal fees if we must pursue recovery
Fees and damages are invoiced within 7 days of the confirmed violation. Unpaid amounts may be referred for collection. We reserve the right to pursue recovery through Indian courts regardless of the fee amount.
6. Cooperation with Law Enforcement
We comply with lawful requests from Indian law enforcement and regulatory authorities, including under the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. If a valid legal order requires us to disclose your information or preserve data, we will do so without prior notice to you where legally required.
7. No Refund on Abuse Termination
Termination for violation of this AUP is not eligible for refund under any circumstances. See our Refund Policy for full details.
8. Appeals
If your service was suspended or terminated and you believe it was in error, email [email protected] within 7 days with evidence. We review appeals in good faith, but reinstatement is not guaranteed.
9. Changes to This Policy
We may update this AUP at any time. Material changes will be announced by email and the "Last updated" date at the top of this page will change. Continued use of our services after an update means you accept the new version.
10. Governing Law
This policy is governed by the laws of India. Any dispute arising under this policy is subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
